This volume includes chapters from an exciting group of scholars at the cutting edge of their fields to present a multi-disciplinary look at how international law shapes behavior. Contributors present overviews of the progress established fields have made in analyzing questions of interest, as well as speculations on the questions or insights that emerging methods might raise. In some chapters, there is a focus on how a particular method might raise or help answer questions, while others focus on a particular (...) international law topic by drawing from a variety of fields through a multi-method approach to highlight how these fields may come together in a single project. Still others use behavioral insights as a form of critique to highlight the blind spots and related mistakes in more traditional analyses of the law. Experiential evidence shows that pain is associated with common meanings. These include a meaning of threat or danger, which is experienced as immediately distressing or unpleasant; cognitive meanings, which are focused on the long-term consequences of having chronic pain; and existential meanings such as hopelessness, which are more about the person with chronic pain than the pain itself. This interdisciplinary book - the second in the three-volume Meanings of Pain series edited by Dr Simon van Rysewyk - aims to better (...) understand pain by describing experiences of pain and the meanings these experiences hold for the people living through them. The lived experiences of pain described here involve various types of chronic pain, including spinal pain, labour pain, rheumatic pain, diabetic peripheral neuropathic pain, fibromyalgia, complex regional pain syndrome, endometriosis-associated pain, and cancer-related pain. Two chapters provide narrative descriptions of pain, recounted and interpreted by people with pain. Language is important to understanding the meaning of pain since it is the primary tool human beings use to manipulate meaning. As discussed in the book, linguistic meaning may hold clues to understanding some pain-related experiences, including the stigmatisation of people with pain, the dynamics of patient-clinician communication, and other issues, such as relationships between pain, public policy and the law, and attempts to develop a taxonomy of pain that is meaningful for patients. Clinical implications are described in each chapter. This book is intended for people with pain, their family members or caregivers, clinicians, researchers, advocates, and policy makers. (shrink)

After rejecting Carruthers' conflation of levels of consciousness as implausible and conceptually muddled, and Carruthers' claim that nonhumans are automata as undermined by evolutionary and ethological considerations, we develop a general criticism of contemporary philosophical approaches which, though recognizing nonhuman consciousness, still see animals as mere receptacles of experiences. This is, we argue, due to the fact that, while in the case of humans we grant a self - something that has not only a descriptive but also a prescriptive (...) side, requiring at least non-interference - in the case of nonhumans we focus only on the descriptive aspects. Consequently, we treat humans as equals whatever their capacities, but we order nonhumans in a hierarchy based on their cognitive level. We conclude that such double standards are not only inconsistent but also self-serving. (shrink)

This third volume of Boston Studies in the Philosophy of Science contains papers which are based upon Colloquia from 1964 to 1966. In most cases, they have been substantially modified subsequent to presentation and discussion. Once again we publish work which goes beyond technical analysis of scientific theories and explanations in order to include philo sophical reflections upon the history of science and also upon the still problematic interactions between metaphysics and science. The philo sophical history of scientific ideas has (...) increasingly been recognized as part of the philosophy of science, and likewise the cultural context of the genesis of such ideas. There is no school or attitude to be taken as de fining the scope or criteria of our Colloquium, and so we seek to under stand both analytic and historical aspects of science. This volume, as the previous two, constitutes a substantial part of our final report to the U. S. National Science Foundation, which has continued its support of the Boston Colloquium for the Philosophy of Science by a grant to Boston University. That report will be concluded by a subse quent volume of these Studies. It is a pleasure to record our thanks to the Foundation for its confidence and funds. We dedicate this book to the memory of Norwood Russell Hanson. Recent research has shown that the superlative quantifiers at least and at most do not have the same type of truth conditions as the comparative quantifiers more than and fewer than. We propose that superlative quantifiers are interpreted at the level of speech acts. We relate them to denegations of speech acts, as in I don’t promise to come, which we analyze as excluding the speech act of a promise to come. Calling such conversational acts that affect future permissible speech (...) acts “meta-speech acts,” we introduce the meta-speech act of a GRANT of a proposition as a denial to assert the negation of that proposition. Superlative quantifiers are analyzed as quantifiers over GRANTS. Thus, John petted at least three rabbits means that the minimal number n such that the speaker GRANTs the proposition that John petted n rabbits is n = 3. We formalize this interpretation in terms of commitment states and commitment spaces, and show how the truth conditions that are derived from it are partly entailed and partly conversationally implicated. We demonstrate how the theory accounts for a wide variety of distributional phenomena of superlative quantifiers, including the contexts in which they can be embedded. (shrink)

Quantum entanglement is a key resource, which grants quantum systems the ability to accomplish tasks that are classically impossible. Here, we apply Feynman's sum-over-histories formalism to interacting bipartite quantum systems and introduce entanglement measures for bipartite quantum histories. Based on the Schmidt decomposition of the matrix comprised of the Feynman propagator complex coefficients, we prove that bipartite quantum histories are entangled if and only if the Schmidt rank of this matrix is larger than 1. The proposed approach highlights the utility (...) of using a separable basis for constructing the bipartite quantum histories and allows for quantification of their entanglement from the complete set of experimentally measured sequential weak values. We then illustrate the nonclassical nature of entangled histories with the use of Hardy's overlapping interferometers and explain why local hidden variable theories are unable to correctly reproduce all observable quantum outcomes. Our theoretical results elucidate how the composite tensor product structure of multipartite quantum systems is naturally extended across time and clarify the difference between quantum histories viewed as projection operators in the history Hilbert space and those viewed as chain operators and propagators in the standard Hilbert space. The superlative quantifiers, at least and at most, are commonly assumed to have the same truth-conditions as the comparative quantifiers more than and fewer than. However, as Geurts & Nouwen have demonstrated, this is wrong, and several theories have been proposed to account for them. In this paper we propose that superlative quantifiers are illocutionary operators; specifically, they modify meta-speech acts.Meta speech-acts are operators that do not express a speech act, but a willingness to make or refrain from making a (...) certain speech act. The classic example is speech act denegation, e.g. I don't promise to come, where the speaker is explicitly refraining from performing the speech act of promising What denegations do is to delimit the future development of conversation, that is, they delimit future admissible speech acts. Hence we call them meta-speech acts. They are not moves in a game, but rather commitments to behave in certain ways in the future. We formalize the notion of meta speech acts as commitment development spaces, which are rooted graphs: The root of the graph describes the commitment development up to the current point in conversation; the continuations from the root describe the admissible future directions.We define and formalize the meta-speech act GRANT, which indicates that the speaker, while not necessarily subscribing to a proposition, refrains from asserting its negation. We propose that superlative quantifiers are quantifiers over GRANTs. Thus, Mary petted at least three rabbits means that the minimal number n such that the speaker GRANTs that Mary petted n rabbits is n = 3. In other words, the speaker denies that Mary petted two, one, or no rabbits, but GRANTs that she petted more.We formalize this interpretation of superlative quantifiers in terms of commitment development spaces, and show how the truth conditions that are derived from it are partly entailed and partly conversationally implicated. We demonstrates how the theory accounts for a wide variety of phenomena regarding the interpretation of superlative quantifiers, their distribution, and the contexts in which they can be embedded. According to the Dilemma Defense, it is question-begging against the incompatibilist defender of the principle of alternative possibilities (PAP) to assume that the agent in a deterministic Frankfurt-style case (FSC) cannot do otherwise in light of causal determinism, but is nevertheless morally responsible. As a result, Fischer (Philos Rev 119:315–336, 2010; Analysis 73:489–496, 2013) attempts to undermine PAP in a different manner via a deterministic FSC. More specifically, Fischer attempts to show that if causal determinism rules out an agent’s moral (...) responsibility, it is not in virtue of its eliminating the agent’s alternative possibilities. I contend that, once we focus upon the distinction between entailment and explanation, the incompatibilist defender of PAP can successfully rebut Fischer’s argument. I argue for this claim while granting Fischer a number of assumptions that only render a defense of PAP more difficult. Additionally, I cast doubt upon Palmer’s (Synthese 191:3847–3864, 2014) critique of Fischer’s argument, which in turn renders my defense of PAP all the more critical. (shrink)

Many pioneers of the Scientific Revolution such as Galileo, Kepler, Stevin, Descartes, Mersenne, and others, wrote extensively about musical theory. This was not a chance interest of a few individual scientists. Rather, it reflects a continuing concern of scientists from Pythagorean times onwards to solve certain quantifiable problems in musical theory. One of the issues involved was technically known as ‘the division of the octave’, the problem, that is, of which notes to make music with. Simon Stevin's contribution to this (...) issue, in his treatise Vande Spiegheling der Singconst , is usually conceived of as a remarkably early plea for equal temperament, which is the tuning system we nowadays all take for granted. In this paper I show that, even though it is true that Stevin calculated the figures for what is now known as equal temperament, in fact the subject of temperament has almost nothing to do with his accompanying considerations, and that, therefore, his calculations served another purpose. A careful analysis of the problem situation in the science of music around 1600, reveals that Stevin's treatise highlights a particular stage in the history of what has always been the core issue of the science of music, namely, the problem of consonance. This is the search for an explanation, on scientific principles, of Pythagoras' law: ‘Why is it that those few musical intervals which affect our ear in a sweet and pleasing manner, correspond to the ratios of the first few integers?’ Through an analysis of the source material available we find that Stevin's theory, which makes no sense if interpreted as an early stage in the ‘evolution’ of equal temperament, was meant as a solution—as freshly original as it was wrongheaded—to this perennial problem of consonance, which has continued to baffle some of the best scientific minds from the very beginning of science to the present day. The Tiger Temple in Kanchanaburi province, western Thailand, is a popular tourist attraction, offering visitors a unique opportunity to interact closely with tigers. It presents itself as a “tiger sanctuary,” whose tigers have been tamed by nonviolent Buddhist methods. This claim has been disputed by visitors and animal welfare activists. This article confronts the Temple’s master narrative of “Buddhist compassion” with a counternarrative of “animal abuse” according to which, rather than being a “sanctuary” for tigers, the Temple in fact mistreats (...) the animals and exploits them commercially. However, even as an animal welfare organization’s report confirmed the abuse of the tigers and called for their confiscation and for the suspension of their display to visitors, the Thai authorities granted the Temple permission to operate as a zoo. This decision highlights the profound contrast between Thai and Western-inspired international norms for the treatment of captive animals. The article examines the cultural roots of this contrast and argues that in their narrow focus on the Tiger Temple the critics have unwittingly missed the opportunity to use the Temple’s animal abuse as an instance of a wider problem in the perception and treatment of animals in Thailand. C'est ce statut d'exception qui éclaire le caractère décisif de l'usage de ces pronoms dans la critique kantienne du cogito. On peut faire apparaître un paradoxe immanent à cet usage au coeur de l'opération de désubstantialisation de la pensée, engagée par Kant dans la Déduction transcendantale et dans les Paralogismes: d'une part, la substitution des pronoms il et ça au pronom je dans (...) le fameux «je pense» permet la réduction de la pensée à sa stricte fonction logique mais, d'autre part, le jeu de substitution des pronoms n'entame pas la fonction d'instanciation d'un sujet "fût-il strictement grammatical" de la pensée dans la formulation du cogito. Cette tension paradoxale entre un sujet désubstantialisé et une «subjectivité», certes neutralisée mais restée néanmoins instanciée dans l'acte de penser, s'accuse dans la deuxième édition de la Critique de la raison pure, qui invente à partir du cogito une nouvelle catégorie d'existence. Kant semble ainsi poser une pierre d'attente pour une nouvelle conception de la subjectivité de la pensée, que nous nommons «le fait-sujet de la pensée responsable» et qui implique une pensée inédite de la constitution du je dans et par la puissance d¿interpellation de la raison. Cette analyse permet une relectura du premier paragraphe de l'Anthropologie du point de vue pragmatique, elle conduit à reconsidérer de manière critique l'interprétation que donne Jacques Derrida du sujet kantien de la pensée dans L'animal que donc je suis et elle inaugure peut-être une nouvelle conception du sujet responsable. Though known for his linguistic scepticism, Kant grants a universal meaning to personal pronouns. It is this exception which accounts for the decisive role that the use of personal pronouns plays in the kantian criticism of the cogito. It can be shown that a paradox inherent to this use emerges at the core of the thought-desubstancializing operation developed by Kant in the Trascendental deduction and the Paralogisms: on one hand, the substitution of the pronoun "I" for the pronouns "he" and "it" in the famous "I think" allows the reduction of thought to its strict logical function, but, on the other hand, the play of pronoun substitution does not prevent the subject of thought "even tough strictly grammatical" from being instanciated in the formula of the cogito. This paradoxical strain between a desubstancialized subject and a "subjectivity" neutralized but nonetheless still instantiated in the act of thinking is to be noted in the second edition of the Critique of pure reason, which derives from the cogito a new category of existence. It seems, therefore, that Kant lays the first ground for a new conception of the subjectivity of thought, which we call "the fact-subject of responsible thought" and which implies a novel notion of the constitution of the "I" in and through the addressing force of reason. This analysis allows for a new understanding of the first paragraph of the Anthropology from a pragmatic point of view, leads us to critically re-consider Jacques Derrida's interpretation of the kantian subject of thought in L'animal que donc je suis , and initiates perhaps a new conception of responsible subject. G.A. Cohen has produced an influential criticism of libertarian‐ism that posits joint ownership of everything in the world other than labor, with each joint owner having a veto right over any potential use of the world. According to Cohen, in that world rationality would require that wealth be divided equally, with no differential accorded to talent, ability, or effort. A closer examination shows that Cohen's argument rests on two central errors of reasoning and does not support his (...) egalitarian conclusions, even granting his assumption of joint ownership. That assumption was rejected by Locke, Pufendorf and other writers on property for reasons that Cohen does not rebut. (shrink)

Myra Hird and Harlan Weaver have been invited by the editors of this special issue to enter into discussion with each other – to conduct a series of interchanges – because of the careful attention their research has paid to the ways in which transness as a lived reality is ontologized in humans, non-human animals, bacteria, and viruses. With this issue’s interchanges, we would like to further the conversation on critically approaching the consequences of merging transness with animality. In (...) the following series of four essay questions, we particularly invited each of these scholars to consider moments of classificatory tension in which taxonomies of human and non-human become inflected and redirected by the categories of race, gender, sexuality, class, ability, and geopolitical location. In Mindblindness, Simon Baron-Cohen presents a model of the evolution and development of "mindreading." He argues that we mindread all the time, effortlessly, automatically, and mostly unconsciously. It is the natural way in which we interpret, predict, and participate in social behavior and communication. We ascribe mental states to people: states such as thoughts, desires, knowledge, and intentions. Building on many years of research, Baron-Cohen concludes that children with autism, suffer from "mindblindness" as a result of a selective (...) impairment in mindreading. For these children, the world is essentially devoid of mental things. Baron-Cohen develops a theory that draws on data from comparative psychology, from developmental, and from neuropsychology. He argues that specific neurocognitive mechanisms have evolved that allow us to mindread, to make sense of actions, to interpret gazes as meaningful, and to decode "the language of the eyes." Immigration politics are almost universally characterized by their complexity, their ability to raise public passions, and misinformation, often based on generalizations and stereotypes. Recently, immigration has been intrinsically linked to crime, and public agendas have squarely focused on security issues as nativist political forces have successfully created a prominent image of migrants as threats to public security. This article argues that immigrant participation in criminal markets should be studied at the local level, where micro-criminal economies often dominated by migrants actually (...) develop. By examining criminal activity at its base, the article investigates the nature of power in these markets. Specifically, it examines migrant crime in four cities and compares it to migrant integration in regular labour markets. By doing so, the article studies levels of migrant autonomy in both criminal and regular markets and argues that this autonomy indicates whether migrant crime is entrepreneurial or a sign of social deviance. Although James Gustafson's use of the Christian Bible and tradition is not fully displayed in the essays published here, Bible and tradition are a crucial part of a composite rationale, which includes experience and the sciences, for his theocentric ethics. Gustafson's theocentric ethics employs the sciences to back, inform, and correct the Christian tradition and offers grounds for respecting the natural piety and morality of “nonreligious” persons while explaining and justifying why Christians draw on major themes and metaphors from their (...) tradition that should penetrate their piety and morality. His proposal should reorient the thinking of theological ethics more than it has thus far. (shrink)

We use a new model of metarepresentational development to predict a cognitive deficit which could explain a crucial component of the social impairment in childhood autism. One of the manifestations of a basic metarepresentational capacity is a ‘ theory of mind ’. We have reason to believe that autistic children lack such a ‘ theory ’. If this were so, then they would be unable to impute beliefs to others and to predict their behaviour. This hypothesis was tested using Wimmer (...) and Perner’s puppet play paradigm. Normal children and those with Down’s syndrome were used as controls for a group of autistic children. Even though the mental age of the autistic children was higher than that of the controls, they alone failed to impute beliefs to others. Thus the dysfunction we have postulated and demonstrated is independent of mental retardation and specific to autism. (shrink)

This volume is a collection of essays concerned with the morality of hu man treatment of nonhuman animals. The contributors take very different approaches to their topics and come to widely divergent conclusions. The goal of the volume as a whole is to shed a brighter light upon an aspect of human life-our relations with the other animals-that has recently seen a great increase in interest and in the generation of heat. The discussions and debates contained herein are addressed by (...) the contributors to each other, to the general public, and to the academic world, especially the biological, philosophical, and political parts of that world. The essays are organized into eight sections by topics, each sec tion beginning with a brief introduction linking the papers and the sec tions to one another. There is also a general introduction and an Epilog that suggests alternate possible ways of organizing the material. The first two sections are concerned with the place of animals in the human world: Section I with the ways humans view animals in literature, philosophy, and other parts of human culture, and Section II with the place of animals in human legal and moral community. The next three sections concern comparisons between human and nonhuman animals: Section III on the rights and wrongs of killing, Section IV on the humanity of animals and the animality of humans, and Section V on questions of the conflict of human and animal interests. Ethics and Advocacy considers the connections and differences between critical reflection or moral arguments or narratives and advocacy for particular issues regarding justice and moral behavior and dispositions. The chapters in this volume share an interest in overcoming polarizing division that does not enable fruitful give-and-take discussion and even possible persuasive justifications. The authors all believe that both ethics and advocacy are important and should inform each other, but each offers a divergent point of view on the way forward to (...) these agreed-upon ends. Our shared goal is to avoid academic withdrawal and to speak relevantly to the important issues of our day while halting--or at least mitigating--the disruptive discourse--almost shouting--that characterizes our polarized current society. I want, this morning, to talk about wants, about how what we want makes us who we are, and how some ways of understanding our own wants and the wants of others shape our lives both personally and politically. There are five parts, respectively personal, political, personal, political, personal.

_The Limits of Utilitarianism _ was first published in 1982. Minnesota Archive Editions uses digital technology to make long-unavailable books once again accessible, and are published unaltered from the original University of Minnesota Press editions. Many philosophers have argued that utilitarianism is an unacceptable moral theory and that promoting the general welfare is at best only one of the legitimate goals of public policy. Utilitarian principles seem to place no limits on the extent to which society may legitimately interfere with (...) a person's liberties - provided that such actions can be shown to promote the long-term welfare of its members. These issues have played a central role in discussions of utilitarianism since the time of Bentham and Mill. Despite criticisms, utilitarianism remains the most influential and widely accepted moral theory of recent times. In this volume contemporary philosophers address four aspects of utilitarianism: the principle of utility; utilitarianism vis-à-vis contractarianism; welfare; and voluntary cooperation and helping others. The editors provide an introduction and a comprehensive bibliography that covers all books and articles published in utilitarianism since 1930. (shrink)

Objectivity is discussed as the underlying ethic of news reporting with an exploration of its origins. A content analysis of the general news reports in six selected U.S. daily newspapers found that objectivity was not widely practiced in 1865?1874, was common in 1905?1914, and normative by 1925?1984. Incidence of objective reporting was evidently not influenced by the introduction of the telegraph and wire services, and there is also no apparent difference between news reports of New York City newspapers and those (...) of other cities.
